Acceptance & Scope

These Terms apply to your use of the MS Accounting website and, at a general level, to professional services supplied by MS Accounting. By using this website, submitting an enquiry or proceeding with services after receiving our engagement terms, you agree to the terms that apply to that interaction.

These Terms do not replace any written engagement letter, service agreement, proposal, scope of work or fee agreement issued for a particular client or matter. If there is an inconsistency, the specific written engagement terms will prevail to the extent of that inconsistency.

A website enquiry does not by itself create a professional adviser-client relationship. An engagement begins only when we agree to act, the relevant scope and terms are accepted, and any required onboarding or identification steps are completed.
02

Professional Engagements

Where we accept an engagement, the services, responsibilities, fees and other material terms may be confirmed in writing. The scope may vary according to the client, entity, reporting period, records supplied and work requested.

Tax agent services are provided subject to applicable Australian law and professional obligations, including requirements that apply to registered tax practitioners under the Tax Agent Services Act 2009 (Cth) and the Code of Professional Conduct.

Our registration details are displayed for transparency as TPB #26218033. Registration does not mean that any particular outcome, refund, tax position or regulatory result is guaranteed.

03

Our Services

Depending on the agreed engagement, MS Accounting may provide services such as:

  • Accounting and bookkeeping support.
  • Individual, business and entity tax return preparation and related tax support.
  • BAS, IAS and GST preparation and lodgment support.
  • Payroll processing and payroll administration support.
  • Business advisory, cash-flow, reporting and management-accounting support.
  • Business, company or entity registration and administration support where included in the agreed scope.
  • Cloud accounting setup, process improvement and related administrative support.

Not every service listed on the website is included in every engagement. We are responsible only for the work expressly agreed with you.

04

Your Responsibilities

Accurate professional work depends on accurate, complete and timely information. Unless otherwise agreed, you are responsible for:

  • Providing complete, accurate and current information and records relevant to the engagement.
  • Reviewing information, returns, reports or documents provided to you for approval and promptly notifying us of errors or omissions you become aware of.
  • Keeping appropriate records and supporting documents required by law.
  • Responding to requests for information within a reasonable time, particularly where statutory or regulatory deadlines apply.
  • Informing us of material changes in your circumstances that may affect the work or advice.
  • Protecting passwords, authentication codes and account access credentials that remain under your control.
  • Making business, investment, financing and commercial decisions for yourself or your organisation.

Unless specifically agreed otherwise, we may rely on information and documents supplied by you or by people you authorise without independently auditing or verifying every item.

05

Advice, Estimates & Reliance

Accounting and tax outcomes depend on the facts, documents, assumptions and law applicable at the relevant time. Any advice is prepared for the client, purpose and circumstances for which it is provided.

Information published on this website is general in nature and is not a substitute for advice based on your particular facts. Website content should not be relied on as personalised tax, accounting, legal, investment or financial-product advice.

Any calculator, fee estimate, projection, forecast, example or indicative amount shown on the website is an estimate only unless expressly confirmed in a written engagement. Actual fees, liabilities, refunds or outcomes may differ.

Tax laws, administrative practices, rates and reporting requirements can change. Advice should be considered in the context of the date it is given and the information then available.
06

Deadlines, Lodgments & Regulatory Matters

Where our engagement includes preparation or lodgment of a return, statement, form or report, we will perform the agreed work using the information available to us and subject to the agreed scope.

Meeting a deadline may depend on you providing all required information, approvals and documents in sufficient time. We are not able to guarantee that a filing or lodgment can be completed by a particular deadline where necessary information, authority or payment is delayed or incomplete.

Government agencies and third-party systems control their own processing times, review processes and decisions. We do not control the ATO, ASIC, banks, superannuation funds, software platforms or other external organisations and cannot guarantee their processing time or outcome.

07

Fees, Estimates & Payment

Fees may be fixed, recurring, time-based or otherwise agreed depending on the service. The applicable fee arrangement will normally be stated in a proposal, engagement letter, invoice or other written communication.

An estimate is not necessarily a fixed-price commitment unless it is expressly described as such. Additional work outside the agreed scope may require a revised fee or separate approval.

Invoices are payable according to the due date or payment terms stated on the invoice or engagement documents. If an account remains unpaid, we may, where lawful and reasonable, pause non-urgent work after giving appropriate notice.

Any entitlement to a refund, fee adjustment or remedy is subject to the circumstances, the agreed engagement terms and any rights that cannot be excluded under Australian law.

08

Third-Party Systems & Service Providers

Our work may involve accounting platforms, payroll systems, document storage, email, website, cloud, banking, government portals or other third-party services. Examples can include products such as Xero or MYOB where relevant to a client’s setup.

Third-party products and services are operated under their own terms, availability, security and functionality. We do not control those providers and are not responsible for a third party’s independent acts, outages, changes or processing decisions, except to the extent that responsibility cannot lawfully be excluded.

Where a third-party subscription, government fee, ASIC fee, software charge or other external cost applies, responsibility for that cost will depend on the agreed engagement.

09

Confidentiality & Privacy

We recognise the confidential nature of client financial and taxation information. Registered tax practitioners are subject to professional confidentiality obligations, including restrictions on disclosing client information without permission unless disclosure is otherwise permitted or required by law.

Personal information is handled in accordance with our Privacy Policy and applicable Australian privacy requirements.

10

Intellectual Property

Unless otherwise stated, the website design, written website content, branding and original materials created by MS Accounting remain the property of MS Accounting or are used with permission.

You may view and use website content for ordinary personal or internal business reference. You must not reproduce, republish, sell, commercially exploit or materially modify our website content without permission, except where permitted by law.

Ownership and permitted use of reports, templates, working papers, deliverables or other materials produced during a professional engagement may be addressed in the specific engagement terms and applicable professional requirements.

11

Liability & Australian Consumer Rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

Where the Australian Consumer Law applies, services may carry statutory guarantees, including guarantees relating to due care and skill and, where applicable, fitness for a stated purpose and supply within a reasonable time when no time is fixed.

To the extent permitted by law, MS Accounting is not responsible for loss caused by inaccurate, incomplete, misleading or late information supplied to us; decisions taken outside the agreed scope; unauthorised changes made by another person; or the independent acts or failures of third parties outside our reasonable control.

We do not attempt through these website Terms to exclude liabilities that Australian law does not permit us to exclude.

12

Suspending or Ending an Engagement

You may ask us to stop acting for you, subject to payment for work already performed and any practical or legal steps required to close or transfer the matter.

We may decline, suspend or end an engagement where there is a lawful and reasonable basis to do so, including where the agreed scope cannot be performed, required information or authority is not provided, fees remain unpaid, a conflict arises, professional obligations prevent us from continuing, or the relationship otherwise becomes unworkable.

Where appropriate, we will seek to provide reasonable notice and deal with client records and transition steps consistently with applicable legal and professional obligations.

13

Website Availability & Acceptable Use

We aim to keep the website useful and available, but we do not guarantee uninterrupted access, error-free operation or permanent availability of any particular feature.

You must not knowingly use the website to interfere with its security or operation, introduce malicious code, attempt unauthorised access, submit unlawful or fraudulent material, impersonate another person or misuse forms and communication functions.

Links to external websites may be provided for convenience or information. A link does not necessarily mean that we endorse every statement, product or service on the external site.

14

Applicable Law & Changes to these Terms

These Terms are intended to operate under applicable Australian law, including relevant Commonwealth and state or territory laws. Any mandatory rights or obligations imposed by applicable law continue to apply.

We may update these Terms from time to time to reflect changes in our services, website, professional practices or legal requirements. The version published on the website will show the date on which it was last updated.

If any provision of these Terms is invalid or unenforceable, the remaining provisions are intended to continue to operate to the extent permitted by law.
